The Australian government’s recent release of its Satellite Utilisation Policy recognises the importance of space-based technologies for the Australian economy and the national interest. Like many developed and developing nations, Australia has come to realise that access to space is an often invisible, but nevertheless critical component of many commercial and governmental activities. Transactions involving space components are becoming increasingly common and have unique risks that need to be understood by legal advisors. As any use of space makes use of resources that form part of the ‘common heritage of mankind’, an appreciation of the international legal framework governing space is also essential to practice in this area. This presentation will touch on some of the special issues that arise where a commercial activity involves satellite technologies.
