The growth of intellectual property (IP) rights in Asia has been prolific. This growth has corresponded with an increase in the number of IP disputes in Asia. While court litigation remains a common dispute resolution mechanism selected by parties in their IP agreements, Asia has been witnessing an increasing number of cross-border disputes concerning IP matters being regularly referred to arbitration in the region. The main reasons for this gravitation towards arbitration lie in many advantages which arbitration offers to commercial parties that court litigation cannot. This paper analyses the reasons for the increasing popularity for arbitration in the IP sector and outlines the advantages of choosing Hong Kong International Arbitration Centre to resolve IP disputes in Hong Kong.
